Council of Europe calls for Poland to promote greater transparency

 The Council of Europe’s Group of States against Corruption (GRECO) on Monday published an evaluation reporturging Poland to promote greater transparency among persons exercising top executive functions.

According to the report, 58 percent of Poles consider corruption widespread. Cases of integrity issues concerning both the police and senior government officials have been reported at regular intervals.

GRECO suggests that an overarching policy and comprehensives rules of conduct accompanied by implementation support measures is needed. A central register would make information more transparent and would strengthen Poland’s arrangements for the declaration of assets. Other recommendations concern the transparency of the government’s legislative process and the rules on access to information, which should be further developed and equipped with an effective appeal mechanism to ensure their effectiveness.

The report further suggests that Poland needs to establish an objective and transparent system for the appointment, promotion and dismissal of all senior managers in the Police and Border Guards. Methods include establishing a proper and reliable risk assessment to assist in the definition of future integrity policies; a rapid clarification of the Internal Supervisory Office’s respective responsibilities and leadership functions; clear and effective rules regarding the disclosure of crimes and misconduct; and the protection of reporting persons.

En su sentencia de fecha 21 de abril de 2016, en el asunto C 377/14 Ernst Georg Radlinger y Helena Radlingerová / Finway a.s, el TJUE declara que la obligación que incumbe al juez nacional de examinar de oficio que los profesionales se atengan a las normas del Derecho de la Unión en materia de protección de los consumidores, también se aplica en los procedimientos concursales. Lo mismo cabe decir respecto de las normas relativas a los contratos de crédito al consumo.

The CEPEJ Working Group on Quality of justice (CEPEJ-GT-QUAL) will hold its 19th meeting on 15 and 16 March 2016 in Strasbourg. The Group will work primarily on the “Guidelines on how to drive changes towards cyber-justice”, as well as on the study identifying actions to be taken by the member States upstream from the introduction of effective domestic remedies required by Article 13 ECHR, with a view to improving the functioning of judicial systems.

“Vamos a volver a reunirnos el 30 de mayo de 2016 para entregar nuestra decisión”, declaró el presidente del tribunal, el juez burkinés Gberdao Gustave Kam.
En la audiencia Mbaye Sène, uno de los abogados del expresidente, pidió que el mandatario sea absuelto de todos los cargos.
“No hubo crímenes en contra de la humanidad, ni crímenes de tortura y menos crímenes de guerra”, dijo el abogado en presencia de Habré.

At its meeting of 29 January 2016, the Committee on Legal Affairs and Human Rights of the Parliamentary Assembly of the Council of Europe adopted Resolution n.2098 which calls upon all member states to implement, fully and in due time, all relevant recommendations of bodies and monitoring mechanisms of the Council of Europe, with particular attention to the guidelines and reports adopted by the CEPEJ through its work on the evaluation of judicial systems.
